3. Account Registration and User Responsibilities

To access certain features of the Service, you must create an account. By creating an account, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account
• Not share your account with any third party

BookGennie reserves the right to suspend or terminate accounts that violate this Acceptable Use Policy at its sole discretion.

5. Payment and Subscription Terms

BookGennie offers both free and paid subscription plans. By subscribing to a paid plan, you agree to the following:

• Subscription fees are billed in advance on a monthly or annual basis as selected
• All payments are processed securely through Xendit. By providing payment information, you authorize us to charge your payment method for all applicable fees
• Subscriptions automatically renew unless cancelled before the renewal date
• You may cancel your subscription at any time through your account settings; cancellation takes effect at the end of the current billing period
• Refunds are provided at BookGennie's discretion and are evaluated on a case-by-case basis
• Prices are subject to change with 30 days' notice to existing subscribers
• Promotional pricing and subscription rates are subject to the specific terms communicated at the time of purchase

6. Intellectual Property

6.1 Your Content

You retain ownership of the ebooks and content you generate using BookGennie, subject to the license granted below. By using the Service, you grant BookGennie a non-exclusive, worldwide, royalty-free license to use, store, and process your inputs and outputs solely for the purpose of providing and improving the Service.

6.2 BookGennie's Intellectual Property

The BookGennie platform, including its design, software, algorithms, frameworks, branding, and all proprietary methodologies (including but not limited to the Success Blueprint Framework, Transformation Habit Framework, and Wealth Intelligence Framework), are the exclusive intellectual property of BookGennie. You may not copy, reproduce, distribute, or create derivative works from any part of the platform without express written permission.

6.3 AI-Generated Content

Content generated by the AI is provided to you for your personal or commercial use. You are responsible for ensuring that the generated content does not infringe any third-party rights before publishing or distributing it.

7. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. BookGennie does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or usefulness of any AI-generated content.

8. Limitation of Liability

To the fullest extent permitted by applicable law, BookGennie and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Service.

In no event shall BookGennie's total liability to you for all claims exceed the amount paid by you to BookGennie in the twelve (12) months preceding the claim.

9. Termination

BookGennie may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, if we believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, warranty disclaimers, and limitations of liability.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under or in connection with these Terms shall be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be submitted to binding arbitration.
